I acknowledge that sailing and sailboat racing are inherently hazardous activities involving risks of personal injury, death, and property damage. I voluntarily assume all such risks, whether known or unknown, including but not limited to collision, capsize, equipment failure, adverse weather, man overboard incidents, drowning, and the acts or omissions of other participants.

I acknowledge and agree that neither the organizing authority nor the race committee, nor their members, nor GybeHub will be responsible for (a) any damage to the entered boat or my other property, or (b) any injury to myself or my crew, including death, sustained as a result of the participation of myself, my crew, and the boat in this event.

I have read and understand the Racing Rules of Sailing, including the Decision to Race rule, and acknowledge that participation in this event is entirely at my own risk.

I, on behalf of myself, my crew, and the entered vessel, hereby release and waive any and all claims against GybeHub, the organizing authority, race committee, protest committee, host club, sponsors, officials, volunteers, and affiliated organizations arising from participation in this event, including claims arising from their ordinary negligence, to the fullest extent permitted by law.

I represent that I am authorized to enter into this agreement on behalf of all crew members sailing on the entered vessel.

I further agree to indemnify and hold harmless the released parties from any claims, liabilities, damages, costs, or expenses, including attorney fees, arising from the participation of myself, my crew, or my vessel in this event.

I have taken all necessary steps to ensure that I, my crew, and the entered vessel are adequately prepared for all reasonably foreseeable contingencies, including carrying all safety equipment required by applicable law and any additional equipment that a prudent seaman would consider advisable.

I acknowledge that I have carefully read this waiver and release, fully understand its terms, and understand that by agreeing to it I am giving up substantial legal rights.

If any provision of this waiver is held unenforceable, the remaining provisions shall remain in full force and effect. This agreement shall be governed by the laws of the State of Michigan.
